1. Introduction

Welcome to Capital Christmas Trees. These Terms and Conditions govern your wholesale purchase of products from our website www.capitalchristmastrees.co.uk (the "Site") and your business relationship with Capital Christmas Trees ("we," "our," or "us"), a trading name of HUBKI MARKETING SOLUTIONS LTD. Please read these terms carefully before placing a wholesale order.

By placing an order through our Site or by phone, you confirm that you have read, understood, and agree to these Terms and Conditions in their entirety. If you do not agree to these Terms and Conditions, please do not use this Site or place an order.

2. Product Information

2.1 Natural Product Variation

All Christmas trees are natural products with unique characteristics. Each tree grows differently and has its own individual shape, density, and features. Images on our website are representative examples only. When purchasing wholesale quantities, natural variation between individual trees should be expected.

2.2 Grading System

We grade our trees as "Standard," "Premium," and "Supreme" based on our professional assessment. These grades represent general quality categories, but natural variation will exist within each grade. Our wholesale pricing is directly tied to these quality grades.

2.3 Natural Growth Patterns

Christmas trees naturally grow with a more slender top than base. This is a natural characteristic of the species and not a defect. Higher grade trees generally have fuller tops than lower grade trees, but all real trees taper toward the top to some degree.

2.4 Size Categories

We provide detailed sizing specifications for wholesale orders. Trees are measured from the cut base to the top of the tree (not including any leader extension). Each size category has a specific height range (e.g., 150-175cm), and trees will fall within this range.

Our competitive wholesale pricing reflects our commitment to providing excellent value. As a wholesale customer, you benefit from significant volume discounts with the understanding that natural products will have variations in appearance. Our grading system allows you to select the appropriate quality tier for your business needs.

3. Ordering Process

3.1 Placing Orders

To place a wholesale order, you must select your preferred tree quantities, sizes, grades, and delivery date through our website checkout process or by contacting our wholesale team directly.

3.2 Accuracy of Information

You are responsible for providing accurate and complete information during the order process, including business details, delivery address, and contact information.

3.3 Order Confirmation

Once your order is complete and payment processed (or credit terms agreed), you will receive an order confirmation via email. Please check this confirmation carefully and contact us immediately if there are any errors.

3.4 Minimum Order Quantities

Wholesale orders are subject to minimum quantity requirements as specified on our website or as communicated by our wholesale team.

3.5 Right to Decline

We reserve the right to decline any order at our discretion or to require advance payment for new wholesale customers or large orders.

4. Pricing and Payment

4.1 Pricing Structure

Our wholesale pricing is structured to provide competitive rates based on volume, grade, and size. Current pricing will be provided upon request or available in your wholesale account portal.

4.2 Price Fluctuations

Due to the seasonal nature of our business, prices may fluctuate based on market conditions, availability, and time of season. Confirmed order prices will be honoured regardless of any subsequent price changes.

4.3 Payment Terms

Standard payment terms for wholesale orders are payment in full at the time of order. Established business customers may apply for credit terms, subject to our approval and credit check processes.

4.4 Late Payments

For customers with approved credit terms, late payments will incur interest at a rate of 8% above the Bank of England base rate. Persistent late payment may result in the withdrawal of credit facilities for future orders.

5. Delivery

5.1 Delivery Scheduling

We work diligently to fulfil all wholesale deliveries on the agreed delivery date and timeframe. Our logistics team will communicate estimated delivery windows approximately 24-48 hours before scheduled delivery.

5.2 Delivery Constraints

In exceptional circumstances, factors beyond our control such as extreme weather conditions, traffic disruptions, or logistical challenges may affect our ability to deliver on the exact chosen date and time. We will communicate any known issues as promptly as possible.

5.3 Stock Availability

Delivery is dependent on stock availability. While we manage our inventory carefully, specific size/grade combinations may become limited during peak periods. In such cases, we will contact you to discuss alternatives.

5.4 Receiving Deliveries

You or your authorised representative must be present at the delivery address to receive and inspect the trees. If no one is available to accept delivery, we will attempt to contact you. Re-delivery may incur additional charges.

5.5 Access Requirements

Please ensure suitable access for delivery vehicles and adequate unloading facilities. Our delivery team will deliver to your designated location where reasonably possible, but we cannot be responsible for access restrictions that prevent standard delivery. Special delivery requirements must be communicated at the time of ordering.

5.6 Pallet Deliveries

Wholesale orders are typically delivered on pallets. You are responsible for having appropriate equipment and staff available to unload palletised deliveries, unless otherwise arranged in advance.

6. Tree Quality and Standards

6.1 Quality Commitment

We select all our trees based on our established quality standards for each grade. We commit to providing healthy, freshly cut trees that meet the general description of the grade purchased.

6.2 Natural Characteristics

Natural characteristics of real Christmas trees include:

  • Variation in branch density
  • Natural tapering toward the top
  • Some degree of asymmetry (trees are not perfectly symmetrical)
  • Variations in trunk straightness
  • Some minimal needle shedding

These natural characteristics are not considered defects and are part of the nature of real Christmas trees.

6.3 Grade Distinctions

Higher grade trees generally have better density, especially at the top, more symmetrical shapes, and better overall appearance compared to lower grade trees. However, all trees will still display natural growth patterns.

7. Inspection and Acceptance

7.1 Inspection at Delivery

We strongly recommend that you inspect the trees at the time of delivery. By signing for receipt of the trees, you acknowledge that you have had the opportunity to inspect the goods and they are received in good condition, subject to the provisions in section 7.2.

7.2 Reporting Issues

Any significant quality issues that are not in line with the ordered grade must be reported to us within 12 hours of delivery. Reports must include:

  • Clear photographs showing the issues across multiple trees
  • Your order number and contact details
  • Detailed description of the concerns
  • Evidence that the issue affects a substantial portion of the delivery

Given that Christmas trees are natural products and our wholesale pricing reflects competitive market rates, please note that occasional variation is to be expected. Our quality assurance process ensures that the vast majority of trees will meet the standards of their grade, but individual tree variation is a normal part of the wholesale tree business.

8. Returns and Resolution Policy

8.1 Limited Return Policy

Due to the nature of our product and our competitive wholesale pricing structure, we operate on a very limited returns basis. Returns or refunds are not standard practice and will be considered only in exceptional circumstances where there is clear evidence that a substantial portion of the delivery does not meet the grade standards ordered.

8.2 Evidence Requirements

Any quality concerns must be substantiated with comprehensive photographic evidence and documentation as outlined in section 7.2. Individual tree variations or isolated quality issues are not grounds for returns or compensation.

8.3 Resolution Approach

In cases where we determine that a substantial quality issue exists that materially affects the merchantability of the delivered products, we may, at our sole discretion:

  • Offer a partial credit on a future order
  • Provide a limited discount on the affected portion of the order
  • In extremely rare cases, arrange for replacement of severely defective trees (subject to availability and logistical considerations)

Our competitive wholesale pricing structure does not include provision for collection of trees after delivery.

8.4 Non-Returnable Circumstances

Returns or compensation will not be considered for:

  • Natural characteristics of real trees as outlined in section 6.2
  • Incorrect size selection (trees too large or small for your requirements)
  • Expectations inconsistent with the natural growth pattern of Christmas trees
  • Damage occurring after delivery due to improper handling, storage, or display
  • Any alterations made to the trees by the customer that result in damage or deterioration
  • Business changes such as reduced customer demand or sales challenges
  • Individual tree variations that are within the normal range for the ordered grade

8.5 Final Determination

Our decision regarding any quality concerns and appropriate resolution will be final, but we will always strive to be fair and reasonable business partners while maintaining the economic viability of our wholesale model.

9. Tree Care and Storage

9.1 Wholesale Storage Guidance

We provide wholesale tree storage and care instructions with each delivery. Following these instructions is essential to maintain the freshness and appearance of your trees until they reach the end customer.

9.2 Key Requirements

Key care requirements for wholesale quantities include:

  • Storing trees in shaded, cool locations
  • Regular irrigation of tree bases
  • Proper stacking and handling practices
  • Appropriate retail display techniques

9.3 Responsibility for Care

We cannot be responsible for deterioration in tree condition due to improper care, storage, or environmental factors after delivery. The wholesale customer assumes responsibility for proper tree care upon receipt.

10. Limitation of Liability

10.1 Limited Liability

Our liability for any claim arising from the supply of trees is strictly limited to the purchase price of the specific trees that are legitimately subject to a quality concern that we have acknowledged in writing.

10.2 Excluded Liability

We are not liable for any consequential losses, business interruption, loss of profit, damage to property, or any other indirect losses arising from the purchase of our products.

10.3 Statutory Rights

Nothing in these terms limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

11. General Terms

11.1 Entire Agreement

These terms and conditions constitute the entire agreement between you and Capital Christmas Trees regarding your wholesale purchase.

11.2 Updates to Terms

We may update these terms from time to time. The terms in effect at the time of your order will apply to that order.

11.3 Severability

If any part of these terms is found to be unenforceable, the remaining provisions will continue to apply.

11.4 Governing Law

These terms are governed by English law, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
